Vision Statement
Imagine a common worldwide map on which people can make visible their examples for the use of renewable energies and energy efficiency to encourage other people in their neighbourhood to use these technologies too – an online map where every example can have an additional effect apart from being a smart investment on its own, by inspiring others. A map that is made known together by a large network of organisations, local authorities, regions and other energy actors having the same objectives. This is our long-term vision.
Introduction
Welcome to repowermap.org! repowermap.org is a non-profit charitable initiative to promote the use of renewable energies and energy efficiency by making visible examples and related local information in each person’s neighbourhood.

The initiative was founded in Bern, Switzerland, in 2008 by the non-profit organisation Association repowermap.org, which was specifically created to carry out this initiative and to maintain it in the long-term. In 2010, the non-profit organisation Association repowermap.eu was founded in Planken, Liechtenstein, with a view to advance the initiative in other European countries in cooperation with a network of European partners, and to ensure its continuation in these countries in the long term.

From 2012 to 2014, the initiative has been supported by the European Union within the framework of the Intelligent Energy Europe Programme, as an initiative to promote renewable energies and energy efficiency by creating synergies in awareness raising between various organisations and energy actors and by facilitating information exchange for the related technologies.

From the beginning, the idea has been to make with this initiative a contribution to climate protection, by promoting renewable energies and energy efficiency with this common interactive map.

In these Terms of Use, Association repowermap.org and Association repowermap.eu are referred to combined as “we” or “us”. Association repowermap.eu is in charge only for activities in the EU or EEA countries, whereas Association repowermap.org is in charge for all countries, having a subsidiary role in the EU or EEA.

To support the achievement of the objectives of the initiative, we provide the essential infrastructure and organizational framework for the development of the initiative. Our intention is to make the map available for the public and a broad network of organisations, regions, local authorities, and other energy actors, having the same goal of promoting renewable energies and energy efficiency, keeping it always free of charge to view and add information to the map.

We welcome you (“you” or the “user”) as an internet user visiting this map platform, as a reader, author, editor, administrator or other contributor to the repowermap.org initiative, and we invite you to find information on this map platform or to contribute to the development of the initiative.

The use of the platform and your contributions to the initiative are subject to the Terms of Use indicated here. By using or accessing this platform, you agree to be bound all the terms indicated in this these Terms of Use. If you do not agree to these Terms of Use, please do not visit or access this platform.
General
These Terms of Use inform what we offer on the repowermap.org platform, what the relationship is to you as user, and what rights and responsibilities we have towards each other.

The large amount of content on the repowermap.org platform to encourage people to use renewable energies and energy efficiency has been brought together by users like yourself. Also the editing and checking of the quality for information added onto the map is made by users, in particular users who have taken the role of administrators. Only in special cases, do we do add information, monitor or delete content ourselves. In general, adding information and editorial control is in the hand of users. Accordingly, the sole responsibility for the content of this webpage lies with the users providing that information. With respect to the content on the map, our role is simply to host the related content. Any opinions expressed by users through the platform are not endorsed by us. We do not guarantee the truthfulness, accuracy, or reliability of any content submitted by users.

You are welcome to contribute to the initiative by adding information to the map, by editing it to improve the content , or by becoming an administrator. Note that you are legally responsible for all your contributions, edits, and re-use of information contained on the repowermap.org platform under the laws of Liechtenstein, if the country from which you are accessing the platform is within the EU or the EEA, and of Switzerland if you are accessing the platform from any other country; in addition, you may be responsible for your related actions under other laws that may be applicable such as the laws where you live or where you view or edit content. With respect to this responsibility, we have prepared some rules that exclude certain content from being added, to protect you or other users like yourself. These rules are, however, a not exhaustive list of rules to observe in order to comply with the related applicable laws.

Other organisations, regions, local authorities or other energy actors supporting the initiative remain legally independent and separate from the Association repowermap.org and the Association repowermap.eu and have no responsibility for the functioning of the website or its content.

The content hosted on the repowermap.org platform is for general informational purposes only. It is in general provided directly by users, who are solely responsible for the related content.

The content does not necessarily reflect the opinion of us, the European Union or the partners carrying out or supporting this mapping initiative. Neither we, these partners, the EACI nor the European Commission are responsible for any use that may be made of the information contained therein. When considering an investment, it is advisable to look for more than one offer and compare.

Accordingly, we are not responsible or liable for the accuracy, completeness, copyright compliance, legality or decency of material of any material contained on or accessed through the platform.

We are not responsible for any content, data or actions of third parties. You release us, our members and employees from any claim which is in any way connected to any claim you have anytime against such third parties.

No information given to you by us through this map platform or in correspondence with us in writing or orally provides any warranty which is not expressly stated in these Terms of Use.

The provision of information and data via internet is always associated with risks and no technological system is completely immune to manipulation and attacks. We cannot be held responsible for such risks. We take measures to a reasonable extent to prevent data from being accessed by unauthorized persons and to minimize associated risks. Similarly, any downloading of content or accessing this platform is carried out at your own risk, and you are solely responsible for any damage to your computer system or loss of data that may result from such downloads or access.

We endeavour to take measures that the quality of the platform is high, but your use of this platform is at your own risk. We provide this platform on an “as is” and “as available” basis. There are no expressed or implied warranties of all kinds, including but not limited warranties of fitness for a particular purpose or non-infringement. We do not give any guarantee that the map platform fulfils your requirements, is safe, secure, uninterrupted, timely, precise or correct.

You agree that we have no responsibility or liability in case part of information you submit to this platform is deleted of fails to be stored or transmitted. Furthermore, we have the right to put into place and enforce limits on use and storage at our sole discretion at any time, with or without notice.
Privacy Policy
Your access to the platform is subject to a Privacy Policy. We ask you to read it to be aware of how personal information is processed. By using the platform, you consent to the Privacy Policy, as also the other Terms of Use. If you do not agree with it, please do not use the platform.
Information hosted on the map
Although users and a network of administrators among them is making quality checks on information provided on the map, you may find some content that is objectionable or incorrect. Making visible the energy revolution with examples in each person’s neighbourhood, as it is the objective of this initiative, is a task that can only be carried out by a large amount of people together. Accordingly, it cannot be excluded that some content on the map is offensive, erroneous, misleading, mislabeled or otherwise objectionable. Common sense needs to be applied when viewing information shown on the map.
Allowed and forbidden activities
The repowermap.org initiative is only possible because of a large number of users like you who contribute to the initiative by providing content, by reviewing or editing it, and to take care for the content. We welcome your participation to this initiative. We ask you to be civil and polite in providing information to the map and in interacting with other users, and to act in good faith.

The following rules have been established to protect you and other users, in particular, concerning activities that you may not engage on our platform:
  • Harassing or threatening others
  • Violating the privacy of others
  • Engaging in false statements, impersonation, defamation, or fraud
  • Infringing copyrights, trademarks, patents, or other proprietary rights under applicable law
  • Misusing the platform for sending unsolicited e-mails, spam, or for any other illegal purposes
  • Engaging in disruptive activities or illegal misuse of the platform
  • Mass registration and automation
  • Posting sexually explicit material

In particular, you are not allowed to add any content that contains viruses, trojan horses, worms , time bombs, malware, or any code, computer programming routine or engine that could harm or detrimentally interfere, surreptitiously intercept or expropriate any system, data or information on our platform or of any other internet user.
Access security
When you are visiting the platform, you may obtain a confirmation code to confirm information you add on the map. You are required to keep that confirmation code confidential. Administrators are furthermore required to keep confidential their access information to areas restricted to administrators.
Use of contents
By providing information to the map, you agree that this information is shown on the interactive map which is the core content of the repowermap.org initiative. You agree that the related content is also shown on maps provided by repowermap.org which are integrated in other websites of organisations, regions, local authorities or other energy actors. You also agree that related information may be used in other activities related to the advancement of the repowermap.org initiative, in particular communication activities for the repowermap.org initiative. You also agree that content may be re-used by other users for non-commercial purposes, as long as they use only a small part of the content available on the map, as defined below.

We ensure that we will not use the data brought together through this initiative for any commercial activity, and that we do not pass on the data to any third party for any commercial activity.

The map provided on this platform may be integrated free of charge in other websites, as long as the related websites are either websites of organisations aiming to promote renewable energies and energy efficiency, are official websites from local, regional, national or international governments, are websites from media platforms, or are websites of any type of energy actor whose intention is to advance the use of renewable energies and energy efficiency. We reserve the right to revoke that permission to integrate the map in specific cases.

You may re-use content shown on the map for personal use or other non-profit activities, as long as you are indicating the source and as long as this does not involve the copying of larger parts of the content of the map. Whenever you intend to re-use more than ten-markers or content from more than ten markers shown on the map, or content from any other part of the website, you are required to get permission by us in writing prior to such re-use. No permission is given to re-use content of the map for any type of commercial activity, if this involves using the content in any other way than by integrating the map, as described above. This does not affect your freedom to use content of which you are the author and that you have added to the map.

The platform is protected by copyright. In other ways than expressly permitted by these Terms of Use, you may not copy, modify, publish, transmit, upload, participate in the transfer or sale of, reproduce, perform, display, create derivative works based on, distribute, or in any other way exploit, any of the content, software, materials, or features of the map platform in whole or in part.
Procedure to remove content infringing copyrights or any other personal right
If you believe that content has been used on the map platform without your permission and that this infringes your rights, you may request the removal of that content.

To make such a request, a letter has to be sent to the address below containing the following information:
  • Indication which right has been infringed
  • If applicable, which work or material has been infringed
  • Indication of the content that is claimed to be infringing, with sufficient detail to allow us to find it and verify that this content is hosted on the platform
  • Contact information about the one making the request, including name, address, telephone number and e-mail address.
  • A confirmation that the one making the request has a good faith belief that the content is infringing his or her rights and that the content is not authorized by the owner, its agent or law
  • A statement made under the penalty of perjury that the information provided in the notice is correct and that the one making the request is authorized to do so on behalf of the owner of the infringed right.
  • The physical signature of the one making the request.

After we have received such a notification letter, we will perform a basic check related to the creditability of the evidence submitted in support of the takedown request, and if we are of the opinion that the takedown request contains substantial evidence, we remove the content temporarily from the platform and inform the author providing the related content within one month. We provide the author the opportunity to provide a counter-notification within one month in case they believe that the takedown request is invalid or improper. This counter-notification has to contain the following information:
  • Reference to the takedown request that had been made
  • The name, address, telephone number, and e-mail address of the user
  • A confirmation with the following text: “I declare, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.”
  • The signature of the user

If such a counter-notification is received, the sender of the original copyright infringement notification will be informed. Unless the sender of the original copyright infringement notifies us within one month that he or she has filed legal action relating to the allegedly infringing material against the user, the content may be put again on the map platform.

Alternatively to this proceeding, a faster way to obtain a clarification of an infringement situation is to edit the content of the map or to contact one of the administrators indicated as contact persons for the country in which the information is shown on the map, inviting them to clarify the situation.
Third party websites and resources
The use of any third-party websites or resources is subject to your responsibility, or the responsibility of the related third parties. Links to third-party websites and resources do not constitute an endorsement, and we are not responsible for any content shown on third-party websites and resources. We are not responsible either for their availability or for their safe use. We do not have any obligation to monitor related third-party content.
Management of content on the map
A network of users of the map having particular administrative functions (network of administrators) has the primary role in enforcing policies established to keep the quality of the map platform high. We reserve the right, however, to become active also from our side to take action to ensure the quality of the platform. We may also be asked to do so by the network of administrators. If we have to take action against a specific user to ensure the quality of the map platform and its smooth functioning, we may, but do not have any obligation, to take among others any type of the following actions:
  • Investigate how you use the map platform to determine if the Terms of Use are violated, or to comply with any applicable law, legal process, or appropriate governmental request
  • Address or prevent fraud, security issues or technical issues
  • Refuse, disable or restrict access to the map platform for any user violating these Terms of Use
  • Ban a user from further participation in the platform in the future
  • Take legal action against users who violate these Terms of Use
  • Take any other action appropriate or necessary to ensure the proper functioning of the platform or to protect the rights of ourselves, users, partners, or the public.

In the extreme case that a user is banned from further participation in the platform in the future, that user is not allowed to access the platform in any way again in the future, unless we have provided explicit permission.

We respect at the same time also the freedom of expression from all users and will not ban without justification.
Termination
We hope you will continue to contribute to the repowermap.org initiative in the future. However, you can stop using the map platform any time. You are free to remove any content from the map you have added on the map any time. Information relating to an installation or building of which you are the owner can be removed by you anytime. Other information you have added on the map, in particular information about public installations or buildings can be removed by you as well, however, the location of the marker on the map may not be removed anymore, as soon as any other user has added information to it, to ensure that related other content can continue to be shown on the map. If we have used any content added by you in other activities, prior to your removal of related content from the map, for example in communication material about the initiative, you allow us to continue using that content in that way.

In certain, hopefully unlikely, cases, it may be necessary for ourselves, the organisations participating in the initiative or the network of administrators to terminate part or all of activities related to the map platform, terminate these Terms of Use, suspend your account, restrict your access, or ban you as a user. We reserve the right to suspend a user’s right to access the platform, to pursue any other remedy or relief in agreement with applicable laws if necessary with respect to a user, to remove any content provided by you, or to interrupt or end the platform or a specific activitiy at any time, with or without justification, and with or without notice.

Even after the termination of your use of the platform, for whatever reason, the Terms of Use remain applicable with respect to those provisions which by their nature are intended to stay in force also after such a termination of use, in particular the sections on the general parts of these Terms of Use, and the sections on disputes, jurisdiction and disclaimers.
Disputes and Jurisdiction
We strive to solve any issues involving you that may arise in a consensual manner. In the event of a dispute, we invite you to find an appropriate solution with the network of administrators . If you intend to file a legal claim against us, you agree to file and resolve it exclusively in Liechtenstein, if the claim relates to activities in the EU or the EEA, or Bern, Switzerland, if the claim relates to activities in any other country. You also agree that the laws of Liechtenstein and Switzerland are applicable, respectively.

To ensure that disputes are dealt with soon after the related issues emerge, you agree that any claim or cause of action you may have related to the use of the map platform or these Terms of Use has to be filed by the latest within one year after the related issues have emerged or could have been discovered with reasonable diligence. Once this period has passed, the related claims cannot be made anymore.
Indemnity
In case any claim or demand is made to us by any third party because of activities you have carried out in breach of these Terms of Use, you will indemnify and hold us, our staff, partners and service providers (including, without limitation, hosting and telecommunications providers) harmless, including costs and lawyers’ fees.
Limitation on Liability
We are not liable to you or anyone else for any damages, whether they are direct, indirect, incidental, special, consequential or exemplary, in connection with the repowermap.org initiative, to the extent that exclusion of such damages is permitted with respect to the applicable laws. At most, our liability under these Terms of Use shall be limited to one hundred Euros.
Changes to these Terms of Use
It may be necessary to change these Terms of Use from time to time. New Terms of Use are published on this page in that case. We ask you to periodically review the most up-to-date version of these Terms of Use. Your continued use of this map platform after the new Terms of Use become official constitutes an acceptance of these Terms of Use on your part. For the protection of the repowermap.org initiative and other users like yourself, if you do not agree with our Terms of Use, you may not use this map platform.
Further terms
With the use of the map platform or your participation in the repowermap.org initiative, no employment, agency, partnership, or joint venture relationship in a legal sense is created between you and us. Unless we have both signed a separate agreement, these Terms of Use are the entire agreement between you and us. In case such a signed separate agreement exists, it will take precedence over these Terms of Use.

You may not assign, transfer or sublicense your rights from these Terms of Use to any other person.

You agree that we may provide you notices by e-mail, regular mail, or postings on the platform’s website. This includes also notices related to the changes of the Terms of Use.

Unless there is a separate agreement between us related to that, you do not have any right for compensation for any activity, contribution, or idea that you provide to us or the repowermap.org initiative in general.

As a result of these Terms of Use or access to the platform, no agency, partnership, joint venture, or employment is created and you do not have any authority of any kind to bind us in any respect whatsoever.

The language of these Terms of Use is English (UK). In case translations of these Terms of use are made into other languages and differences in interpretation can be made between them, it is the English version which is valid.

If any provision or part of a provision of these Terms of Use is found to be invalid, the other parts of the Terms of Use remain valid.

Contributions by you and other people who are convinced of the necessity of climate protection and a secure energy system and who see the opportunities that renewable energies and energy efficiency provide, make it possible to carry out this large-scale bottom-up initiative. With your contribution, you can make a difference not just by your own action when using or installing such technologies yourself, but to provide also inspiration to others, to make more people use and support these technologies.
